Copyright: the facts
The origin of copyright protection in this country is the Constitution of the United States.
Congress can pass laws to promote the progress of science and the useful arts, by securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries.
Copyright law of the United States is the Copyright Act of 1976
Grants exclusive rights for a creation of an original expression that is fixed in a tangible medium of expression
Copyright protects the unique expression of an idea, but not the idea itself.
What is Original Expression?
Expenditure of a modicum of intellectual effort
Originality
Include but not limited to:
Literary Works, Musical Works (including words), Dramatic Works (including music), Pantomimes & Choreographic works, Pictorial, Graphic and Sculptural Works, Motion Picture and Audiovisual Works, Sound Recordings, Architectural Works (after 12/1/90)
What is Tangible Medium?
A work is “fixed” when it is sufficiently permanent or stable to permit it to be perceived, reproduced, or otherwise communicated for a period of more than a transitory duration.
Copyright Fact & Confusion
If the copyright act was intended to assure the author the right to their original expression and secure for a limited time to authors and inventors the exclusive rights to their respective writings and discoveries, but encourage others to build freely upon the ideas and information conveyed by the work .

Fair use permits the use of copyrighted work without the permission of the copyright owner when the use is for criticism, commentary, news reporting, teaching, scholarship & research
Can include copying portions of a work including making multiple copies for classroom use
Copyright & the Internet
Material on the web is not automatically in the public domain
Most websites were developed after 1976 and may be protected without copyright notice
Many websites contain pirated works, so don’t assume that the author of the site owns or has permission to use the work displayed on the site
Look closely for restrictions on website
