What is copyright?
Copyright refers to laws that regulate the use of the work of a creator, such as an artist or author. This includes copying, distributing, altering and displaying creative, literary and other types of work. Unless otherwise stated in a contract, the author or creator of a work retains the copyright.
Copyright in india
After independence first copyright act came in 1957 .
1957 Act: adopted many English provisions, introduced new ideas and concepts
It was started from 21 January 1958.
Procedure for Copyright
1. Name, address and nationality of the applicant
2. Name, address and nationality of the author of the work 3
3. Nature of applicant’s interest in the copyright i.e. OWNER / LICENSEE etc.
4. Title of the work
5. A declaration signed by the author (if different from the applicant)
6. Language of the work
7. Whether the work is published or unpublished
8. If the work is published, year and country of first publication and name, address and nationality of the publisher
9. Year and countries of subsequent publications, if any
10. Name, address and nationality of any other person authorized to assign or license the rights in the copyright
FOCUS
Lawyers for Cameron had focused on elements of Schkeiban's argument in which he suggested that wheelchair-bound Avatar hero Jake Sully was based on his own protagonist, a small boy, because both were physically "weak".
He also argued that a segue in which the bad guys turn on the good guys was based on his own similar twist.
Schkeiban had also claimed that the multi-levelled homes inhabited by the Na'vi tribe on Avatar's moon, Pandora, were comparable to the plants and trees seen in Bats and Butterflies
RESULT
In his judgment, US district court Judge Manuel Real said Schkeiban's screenplay for a film titled Bats and Butterflies, based on his own series of children's books, was "not substantially similar" to Avatar.
Real ruled that Bats and Butterflies was "a straightforward children's story that lacks the depth and complexity of the moods expressed in Avatar".
Conclusion
Requires complete overhauling of the Copyright offices
At present most copyrightable works are not registered
Even copyright registrations where the traditional examination and opposition procedures are not followed, take time sometimes even 3 years to get registered
For biotech industry, a vibrant and robust copyright registration regime, is necessary
Priority would be difficult to establish.
